If your family class sponsorship (especially spousal sponsorship) application got refused in
many cases, sponsors have the right to appeal the decision to the Immigration Appeal
Division (IAD) of the Immigration and Refugee Board of Canada.

*Note-Inland spousal sponsorship refusals do not have the right of appeal to IAD.

After the refusal the sponsor have the chance to file the Appeal to the member of the
Board of the Immigration Appeal division but the time is very limited. You must file a
Notice of Appeal within 30 days of receiving the letter of refusal.

Appeal allows you to:

➢ Challenge the immigration officer’s decision
➢ Present new evidence and testimonials
➢ Demonstrate the genuineness of your relationship and provide witnesses
➢ To prove that the refusal was incorrect, immigration officer made the wrong decision
➢ Humanitarian and Compassionate (H &C) grounds to be considered in the
application.

Common Reasons for Spousal Sponsorship Applications Are Refused

• The officer believes the relationship is not genuine
• The marriage or relationship was entered into primarily for immigration purposes
(Marriage of convenience)
• Insufficient proof of cohabitation or ongoing relationship

• Inconsistencies in interviews or documents
